These Terms of Service (“Terms”) govern your access to and use of the WaveRay Android mobile application, Windows desktop application, related websites, software, features, and services collectively referred to as the “Service.”
The Service is provided by Hangzhou Xishang Technology Co., Ltd. (“WaveRay,” “we,” “us,” or “our”).
By creating an account, accessing, purchasing, or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
1. The WaveRay Service
WaveRay provides tools related to applied optics, physical optics, optical engineering, optical simulation, optical calculation, visualization, analysis, and related technical workflows.
Some functions may be available free of charge. Other functions may require a paid subscription.
WaveRay is available in separate Android and Windows versions. Features, interfaces, file handling, purchase options, and supported workflows may differ between the two platforms. We may add, modify, suspend, or remove features as the Service develops.
2. Engineering and Scientific Disclaimer
WaveRay is intended to assist with optical calculation, simulation, education, research, and engineering analysis.
Results produced by the Service may depend on user inputs, mathematical assumptions, numerical methods, material data, approximation methods, device limitations, and software configuration.
We do not guarantee that calculations, simulations, graphs, material parameters, recommendations, or exported results are complete, error-free, or suitable for every purpose.
You are responsible for independently reviewing and validating important results before relying on them in research, manufacturing, product design, safety-related systems, regulated applications, or commercial decisions.
WaveRay is not a substitute for qualified professional judgment, laboratory measurement, certified engineering software, regulatory testing, or independent verification.
3. Account Registration
Some features require a WaveRay account.
You may be able to register or sign in using:
- Email and password
- Microsoft personal accounts
- Microsoft organizational or educational accounts
You must provide accurate account information and keep your login credentials secure.
Your username or display name is used only as profile information. It is not your primary login credential.
You are responsible for activity performed through your account unless the activity resulted from a security failure caused by us.
You must notify us promptly if you believe your account has been accessed without authorization.
4. Account Eligibility
You must be legally capable of entering into a binding agreement in your country or region.
If you use WaveRay on behalf of a company, university, laboratory, or other organization, you confirm that you are authorized to accept these Terms on its behalf.
The Service is not specifically directed to children. Users who have not reached the minimum legal age required in their jurisdiction must use the Service only with authorization from a parent, guardian, school, or other responsible organization where required by law.
5. Free and Paid Features
WaveRay may provide a combination of:
- Free features
- Limited free access
- Subscription-only features
- Promotional or trial access
- Features that vary by platform, country, device, or application version
The availability of a feature in one version of WaveRay does not guarantee that the same feature will be available in another version.
We may change which features are free or paid. Any change affecting an active paid subscription will be handled in accordance with applicable law and the rules of the platform through which the subscription was purchased.
6. Subscriptions
Paid features may be offered through automatically renewing subscriptions.
Before purchasing, you will be shown the subscription price, billing period, available features, and any applicable trial or promotional conditions.
Unless canceled before the applicable renewal date, a subscription may automatically renew and the relevant application store or payment provider may charge the payment method associated with your account.
Prices may vary by country, currency, tax rules, platform, promotional offer, and subscription plan.
Android subscriptions purchased through Google Play are managed through the user’s Google Play account.
Windows subscriptions may be managed through Microsoft Store or another clearly disclosed payment provider, depending on how the Windows version is distributed.
7. Cancellation and Refunds
You may cancel a subscription through the application store or payment provider used for the purchase.
Canceling a subscription normally prevents future renewal. Unless otherwise required by applicable law or the rules of the relevant application store, paid access may continue until the end of the current billing period.
Deleting the WaveRay application or deleting a WaveRay account does not necessarily cancel an active subscription. You must cancel the subscription through the relevant application store or payment provider.
Refund requests are handled according to:
- The refund rules of Google Play, Microsoft Store, or the applicable payment provider
- Applicable consumer protection laws
- Any additional refund policy displayed at the time of purchase

8. Trials and Promotional Offers
We may offer free trials, discounted periods, introductory pricing, or other promotions.
Eligibility, duration, pricing, renewal terms, and restrictions will be displayed before enrollment.
Unless canceled before the end of a trial or promotional period, the subscription may convert into a paid subscription at the displayed price.
We may limit promotional offers to eligible users, devices, accounts, countries, or time periods.
9. Local Project Data
Unless a feature expressly states otherwise, WaveRay optical projects, optical parameters, simulation results, calculation results, graphs, reports, and project files are stored locally on the user’s device.
These files are not automatically synchronized between Android and Windows devices.
You are responsible for:
- Protecting your local files
- Creating backups where appropriate
- Exporting important projects before uninstalling the application
- Protecting access to your device
- Confirming that exported files are complete and usable
Local data may be lost because of device failure, operating-system changes, application removal, storage corruption, user error, or device replacement.
We are not responsible for local data loss that is outside our reasonable control.
If cloud backup or synchronization is introduced in the future, the feature and its related data practices will be clearly disclosed.
10. Account and Profile Data
WaveRay may process account authentication information and optional profile information necessary to operate the account system.
This may include:
- User identification number
- Email address
- Authentication provider
- Email verification status
- Username
- Display name
- Profile image address
- Account creation and update information
The handling of personal information is described in the WaveRay Privacy Policy.
11. Third-Party Services
WaveRay may use third-party services to provide authentication, application distribution, subscription management, infrastructure, or other functionality.
These services may include:
- Supabase
- Google Play
- Microsoft
- Microsoft Entra
- Microsoft Store
Your use of a third-party account, application store, or payment service is also governed by that provider’s terms and privacy policies.
We are not responsible for outages, account restrictions, billing errors, policy changes, or other actions controlled solely by third-party providers.
12. Acceptable Use
You must not:
- Use the Service for unlawful, fraudulent, abusive, or deceptive purposes
- Attempt to access another user’s account or private information
- Circumvent authentication, subscription, licensing, or security controls
- Reverse engineer, decompile, or disassemble the Service except where applicable law expressly permits it
- Introduce malware, harmful code, automated attacks, or excessive requests
- Interfere with servers, databases, authentication systems, or other users
- Misrepresent WaveRay results as officially certified, independently verified, or guaranteed
- Use the Service in a way that infringes intellectual-property rights or other legal rights
- Resell, sublicense, or commercially redistribute the Service without written authorization
We may restrict or suspend access when reasonably necessary to protect users, systems, intellectual property, or legal compliance.
13. Intellectual Property
The WaveRay software, interface, design, branding, documentation, text, graphics, databases, and original content are owned by or licensed to Hangzhou Xishang Technology Co., Ltd.
These Terms grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
The license does not transfer ownership of WaveRay or any related intellectual property.
You retain ownership of optical projects, inputs, calculations, notes, and other original material that you create using the Service.
14. Updates and Compatibility
We may release updates to improve functionality, security, accuracy, compatibility, or compliance.
Some updates may be required for continued access to the Service.
We do not guarantee compatibility with every device, operating-system version, graphics system, hardware configuration, third-party package, or file format.
Older versions may stop functioning after security, infrastructure, application-store, or authentication changes.
15. Availability
We aim to provide a reliable Service but do not guarantee uninterrupted availability.
The Service may be temporarily unavailable because of maintenance, updates, security incidents, third-party outages, network problems, technical failures, or circumstances outside our reasonable control.
We may discontinue all or part of the Service. Where reasonably possible, we will provide advance notice when discontinuation materially affects active paid users.
16. Suspension and Termination
You may stop using WaveRay at any time.
We may suspend or terminate access if:
- You materially violate these Terms
- Your use presents a security or legal risk
- Payment for a paid service fails or is reversed
- We are required to do so by law or an application-store provider
- The Service or relevant feature is discontinued
Termination of a WaveRay account does not automatically cancel subscriptions purchased through an external application store.
Before deleting your account or uninstalling WaveRay, you should export or back up any important locally stored files.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.
We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, and compatibility, except where such warranties cannot legally be excluded.
Nothing in these Terms excludes mandatory consumer rights that apply in your country or region.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Hangzhou Xishang Technology Co., Ltd. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes loss of data, loss of revenue, loss of profits, loss of business opportunity, loss of research time, production loss, device damage, or losses resulting from reliance on calculations or simulation results.
Where liability cannot legally be excluded, our liability will be limited to the amount paid by you for the affected WaveRay service during the twelve months preceding the event giving rise to the claim, unless applicable law requires a different remedy.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
19. Privacy
Your use of the Service is also governed by the WaveRay Privacy Policy.
The Privacy Policy will explain what information is processed, why it is processed, which service providers may receive it, how it is protected, and what rights may be available to users.
20. Changes to These Terms
We may update these Terms to reflect changes in the Service, subscription model, security practices, legal requirements, or application-store policies.
The updated version will show a revised effective date.
Where required by law, we will provide additional notice or request renewed consent before material changes take effect.
Continued use of the Service after an updated version becomes effective constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.
21. Governing Law
Except where mandatory consumer law provides otherwise, these Terms are governed by the laws of the People’s Republic of China.
Users may retain mandatory rights and remedies available under the laws of their country or region.
